New California Bank Levy Law
With each New Year comes a laundry list of new laws on the books, numerous of which you’ll never hear about. The major law worrying our clients this year is California Assembly Bill 2364.
The statute, which took effect January 1, 2013, governs the service of certain legal procedures against deposit accounts, safe deposit boxes and personal homes held by the largest California financial institutions. Exactly what does this mean for you?
It basically means if you require a bank levy, writ of execution, or some other judgment collection served, it will should be served to a centralized location designated by Bank of America through the California Department of Financial Institutions. Refraining from doing so will render your service void. If you do not live near the central Bank of America center, the only way you could have your notice of levy served is with a qualified process server or the regional Sheriff, however the sheriff’s office has major delays and is backed up for occasionally 3 months or even more.
If you try to serve the documents to the specific establishment that maintains the account in question, your package will be disregarded, and potentially even worse, ended. Now that Bank of America has designated its centralized facility for the service of civil levies, checking account garnishments, attachments and various other legal procedure, you must follow the appropriate process to ensure your judgment collection progresses and you begin obtaining repayments.
